*The Gabriel Aubry/Halle Berry/Olivier Martinez mess keeps getting messier.
Aubry, according to TMZ, is going to family court today to ask a judge to lift the order prohibiting him from seeing his daughter in the wake of his now infamous Thanksgiving day beatdown.
As was reported, Aubry was arrested for battery … a judge issued an emergency protective order blocking Aubry from coming within 100 yards of Halle Berry, Nahla and Olivier Martinez.
We’re told Gabriel’s lawyers will argue Olivier instigated the fight, beating the model to a pulp in Halle’s motor court and even repeatedly slamming his head on the concrete.
We’re told Halle’s lawyers will be in court this morning to oppose Gabriel’s motion … and Halle may show.
Meanwhile, on Monday, Gabriel Aubry obtained a restraining order against Olivier Martinez.

Olivier had some nerve telling Gabriel that he and Halle were going to take Nahla and he wasn’t going to follow them.
Whoa! The girl who took the upcut from that bus driver looked nothing like this! Martinez did the mumba on Aubry’s face. DAMMMMMMNNNNN!! LOL!
I had no idea that Martinez used to be a boxer. He really went upside Gabriel’s head. My goodness. How did it get this volatile between Aubry and Martinez? Obviously, it looked like Martinez issued Aubry a beatdown but all of that because Halle could not move to Paris with Nahla? There is something more to this story than what’s being told.
The fight to prevent Halle from moving to France with Nahla was VERY expensive. As Olivier said, “It cost us $3 million.”
Me either but it’s rather clear that this was a serious beatdown precipitated by something other than what happened on this day. Likely, Oliver felt as if he was protecting Halle’s honor by beating Gab. I can’t see this didn’t last longer than a few seconds and wonder did Halle do ANYTHING to interject herself between these two men who obviously dislike each other.
She had to know the personalities of both and should’ve anticipated her daughter seeing her father being brutally beaten.
All of this drama is ” so unnecessary” and quite sad really because an innocent child is caught in the middle of squabbling among adults who cannot seem to get their act together.
Something tells me this is not their first altercation with each other and that this was the tipping point. A very sad case for Nahla.
It wouldn’t surprise me one bit if the judge removed her daughter from her custody. She has major issues…if she knew how he was, she should have made arrangements to have a peaceful hand off of the child but to put the child in harms way to see all this shyt really speaks volumes. She is one crazy bitch!

According to Gabriel’s supporting affidavit for the TRO, Nahla had already gone inside the house before the fight started. So most likely, she didn’t see anything.
Interesting though, if you look at the photo of Halle, Olivier and Nahla in the car together … HALLE HERSELF looks a little scared.

Showing how Ollie has quite the temper on him, and we know that’s not a good thing for any one, especially a little girl to be around. I agree she looked worried/scared, makes me wonder if he’d tapped her up a couple times. She’s no stranger to a fist.

OK, so this was an ass whupping that was long overdue, and if Oliver didn’t deliver, I’m sure some other guy in Halle’s life would eventually oblige. But I’m still a bit skeptical how the cops handled it. They say Halle called that someone was assaulting her boyfriend. So the cops got there, found this man who technically wasn’t trespassing and arrest him based only on that?! Was there any corroborating evidence from a witness?
The police have a lot of latitude in when it comes to making an arrest. They basically can choose to believe whoever they want. Now of course you will have your day in court, but for a regular Joe, this could mean thousands of dollars in legal fees. I know someone recently who picked up a felony resisting arrest with a vehicle charge because they did not yield to the cops behind with their lights flashing. The cop was pissed because they thought someone was avoiding them, so they threw the book at them. Who going to reimburse you for the fee you had to pay to a bondsman?
I just wish more was demanded of police officers in conducting themselves in a professional manner. Right now, cops have too much power. Citizens should have the right to sue them for an unfair arrest.
I think the outcome of this custody battle is going to shock the shit out of EVERYBODY including Halle. California Family Courts is NO JOKE especially when kids are involved…I had a case where the kids went to visit the mom and she refused to give them back to the father who had sole physical and sole legal custody…she tried to run down to child support thinking she was going to get custody…during mediation, she was slandering the father on baseless facts while he worked and was doing the best he could to support the kids and the judge threw the book at her ass. All visitation must be supervised and she has complete anger management classes…needless to say, they haven’t heard a word from her since Court and that was in July…
Yes, I suspect we can expect to see a guardian ad litem appointed for Nahla.
