*A discrimination lawsuit has been filed against the Kardashians’ Dash boutique, founded by Kourtney, Kim and Khloe Kardashian in 2006.

Andres Gomez, who is legally blind, says he wanted to shop the store online after learning about its location on Collins Avenue in Miami. (The Dash boutique also is located in Los Angeles and New York.)

According to the lawsuit filed last week in the Southern District of Florida in Miami, Gomez uses JAWS Screen Reader software to access the internet, but the Dash website wasn’t compatible with the software he was using nor were there any other options available on the site.

Gomez is suing the clothing boutique for discriminating against the blind by being inaccessible to the visually impaired. According to The Hollywood Reporter, the suit argues that the website’s lack of access violates the Americans with Disabilities Act (ADA) and the Electronic Communications Privacy Act.

“The vision and blind population is expected to double by 2050,” read the court document. “It is essential that low vision and blind individuals are not excluded from society and segregated in areas of web commerce.”

Gomez is asking the court to require the defendant to update its website to display the universal disable logo. Additionally, the plaintiff is asking for the company to pay for damages, attorney’s fees and any additional payments deemed necessary.

Gomez has previously made the same claim against retailers Coach, Ralph Lauren and Payless.
