Why Shirley Caesar Filed an Injunction to Remove This Particular ‘#UNameItChallenge Video

*Scores of videos were created and posted as part of the Thanksgiving-themed #UNameItChallenge that recently dominated social media, but gospel legend and evangelist Shirley Caesar, whose song “Hold My Mule” was sampled for the phenomenon, has taken legal action to shut down only one of them.

DJ Suede of Gwinnett County, Georgia posted this original #UNameItChallenge in November that was initially well received by Caesar and her family:

But then DJ Suede went and made a second video with images of alcohol that, according to Caesar’s legal team, “violate the brand, image and name of a Christian pastor,” reports CBS46.

“Unknown to us, he made the second video,” said the singer’s lead attorney James Walker, describing it as a full-fledged production which was sold on iTunes. Caesar’s legal team has filed an injunction against DJ Suede, Jullian Boothe and Empire Distribution claiming this particular video marks an unauthorized use of her sermon and song.

Caesar also alleges the video is worth more than $5 million in losses, because she had already contracted with Snoop Dogg to film a full-fledged video of the song, with proceeds from that deal earmarked for the hungry. Judge Glenda Hatchett, the former TV court judge who is working with Walker’s office on the case, alleges the second video jeopardized the Snoop deal.

“DJ Suede and his management were in conversations with her lawyer. They didn’t reach an agreement and they put it out anyway,” Hatchett said.

The video made by Snoop was a clean version also made as part of the #UNameItChallenge craze. Walker said the goal of Snoop’s video was to remind everyone whose voice was at the center of it all.

“Snoop did his clean version to send the message that ‘this is Shirley Caesar’, We need to honor her,'” Walker said.

The court case will return to court on Dec. 21.
