Comment: I can't knock the brother for sending his creative out in a mass mailing. His biggest mistake was not getting a copyright - it would make this a clear cut, no stop at court multimillion dollar mistake for the Foxx man and his cronies!

Comment: I don't know about this one. but, isn't the procedure is to get a music agent of some sort to handle your business of submitting your work to various music labels to make sure you won't get stung by someone else stealing your stuff. if you mass mail your stuff out there and it's "hand written" it's ripe for the picking. and when you say it's copywrited then you should have the proper papers to back that up and i mean papers from the Library of Congress. a copy of that form should have went with your music too. that way the producers would know that this piece is legitamately written by you. when you go to court, i hope you have them, my brother, cause if you don't you are up the creek.

Comment: when you are a writer (music lyics, plays, screenplays, author)as soon as you finish it make a copy of your stuff and send the orginal to the Library of Congress. go to your nearest libary and ask for form PA (performing arts if you are writing a stage or screen script) there are different forms for different pieces just ask the libarian for which one you need (if you are an avid writer i suggest you make copies of this form to keep in your files!) and you will have to pay a fee of 35.00 for processing. so you include the orginal script, the form and a check and send it to the Library of Congress. Now, there is another way to Copywright and this is what mr johnson probally did and to be honest, i would not do this, they call it "the poor man's way to copywright". put your orginal in a envelope and mail it back to yourself and don't open it when it comes back. IF YOU ARE SERIOUS ABOUT YOUR STUFF NOT GETTING RIPPED OFF, DON'T DO THIS!! you put your blood, sweat, and tears into your stuff and you want it to be legit, do it the right way by submitting it to the Library of Congress. that way you will have the legal form to back up your claim as legitamite proof. everything i'v written, i had it copywritten and i have the forms on file. yeah, it may take a while to get it back but before you send off the form make a copy of that to esure that you have proof that your form was sent off to be copywritten. PROTECT YOUR STUFF!! YOU WORKED TOO HARD TO CREATE IT. ITS YOURS AND YOURS ALONE.

Post marked documentation can be deemed legally binding in the court of Law (in some cases). What a lot of people don't know is that he could have mailed a copy of the music to himself and kept it in his records. Some states have laws that allow potmarked mail to be deemed legally binding and presntative evidence in the court of Law. Again, the statutes vary from state to state, but I believe Michigan's laws may have been written with a bit of ambuguity. I'd have to pull out some of my legal docs to research this. The easy solution would have been to copyright two things:, the music and his lyrics(using the formal legal processes), and disseminate it to Record Companies in a professional manner. Not handwritten on a steno notepad, but written on watermarked paper with your case number, copyright markings, and a legal and bidding contract if they agree to use your music and/or lyrics. Not only that, but you courtesy copy your legal team on everything you send. I eman typically your attorneys will do the leg work. But I digress. In my opinion, this guy's case is very weak and has a lot of holes.

Comment: I also meant to include that when you get the info back from the Libary of Congress, they will send you back a certificate the the Library of Congress seal on it and the copy of the form you sent. like i said, this may take a while to process because they have to do research on your stuff to make sure no one else has written the same thing. but like i said, before you submit your stuff. make a copy of the form for your records. if you want to download the forms you want, you can. go to www. library of congress.com and click copyrights.

Comment: No Chassie you can do it yourself. In the old days when I started writing I would mail the music to myself with a postmark as proof of my ownership. It is an outdated mode of copywrite protection today but it does work.

And even if it is properly protected by copyright regostration with LOC, you dont send out mass mailings..that's not how it works....Forget "Poorman's copyright." (mailing to yourself as copyright) It doesnt always hold up in court. How can he prove that Jamie got his lyrics? He has to be able to prove that Jamie had access to his lyrics. DId Jamie sign a Non Disclosure Agreement?

Comment: BIGCHASIE The regostration form being sent is not standard procedure especially if youre send out unsolicited. If the label, production company, producer, etc requested you to send your material, best to send a non-disclosure agreement and MAYBE the registration form.....actually, of course, an agent, manager or representative (Entertainment Attorney) is best to handle submission matters.

Comment: To be honest, when Jamie was explaining his inspiration for the song on Oprah, it didn't seem to fit the song to me. Especially the part about a couple not able to have a child. Didn't one of Jamie's girlfriends get knocked up and that's how his daughter was conceived?!? That just doesn't sound like a situation where a couple has been trying forever to have a child. It just didn't sound right to me. But I just attributed it to Jamie being corny. LOL

Comment: Artists and record companies are always looking to steal somebody's ideas...One of the fringe benefits of touring is that the cats who pay mad money to get backstage and try to audition for their favorite artist end up getting dismissed and then the best parts of their original creations co-opted or outright stolen into their favorite artist's next album or album after next....they stay fresh by stealing the new kid on the block's hot ideas!
