Comment: Brandy will indeed have to pay something. She'll most likely be convicted of the misdemeanor charge, which will strengthen the hand of the legitimate lawsuits. Hopefully she has adequate insurance**. At this point the only happy people in this whole affair are the lawyers. **A few years ago, I upped my auto liability insurance from the state mandatory $25,000 to $100,000 (I can't precisely remember why). It only cost a few dollars more per month, and if I were a celebrity I'd probably carry a few million in coverage.

Comment: It has already been reported that the parent's lawsuit would not be entertained and the suit by this 50 year old female should be thrown out as well as she suffered not a damn thing. This is just another case of someone wanting a big payday.

Comment: Maybe that is the way lawsuits are written, I'm not sure. But it seems as if they imply that Brandy did this on purpose, like she went out of her way to ram the car. She hasn't been charged with doing so, so it's hard for me to believe that Brandy "recklessly wantonly, unlawfully, and maliciously" operated the car. If the woman is injured, I hope she gets her medical bills paid and that kind of thing, but I don't think it's fair for her to drag Brandy's character through the mud. Yes, Brandy messed up, but maliciously? Come on.

Comment: OSUN - I don't think whether or not you have insurance has anything to do with a person's right to sue someone. If you have insurance, I think the insurance company typically handles the lawsuit for you up to the amount of your coverage.

That way, if the jury does not find the person guilty of first-degree murder, he doesn't just walk. He can still be convicted of second-degree murder, but ONLY IF it is included in the complaint. Comment: Having insurance isn't directly related to someone's ability to sue you but having ADEQUATE insurance will directly be related to one's ability to within and civil suits that arise out of an accident. Unfortunately when most people insure a vehicle they only think about a car accident or what the mandatory amount is. They don't think about what other property and value they may lose and under insure themselves. I know someone whose child took the family's third car and wrecked it. During the wreckage, they also hit numerous cars. Not only are they concerned that they don't have enough insurance to cover the cars that were hit -- they are also concerned they may lose their home because they don't have enough insurance on their personal property either. What happened to Brandy can happen to anyone...the car she hit, hit the car with the women in it who died. I'm pretty sure the insurance company who insured the car who hit the women forcing her into oncoming traffic -- which caused her death made the owner of that car (which was hit by Brandy) go after Brandy. It seems pretty obvious she doesn't have supplemental insurance or this would have never gotten this far.

Comment: Did I hear/read somewhere that Brandy "may have been" on a cell phone or sending a text message when the accident happened? I can't tell you how many people on the road I see doing reckless/stupid things only to pull up next to them to see a cell phone in their hand up next to their ear. In fact, I mentioned to someone recently that I wonder how many of the serious/fatal car accidents that have occurred over the past few years were caused while someone was on a cell phone. It seems as if people don't realize that if you're holding a cell phone up to your ear, not only is your full concentration not on the road, but you have AUTOMATICALLY blocked your blind spot. Even with the advent (and now requirement, in some jurisdictions) of hands-free devices, we have GOT to be more careful when using cell phones while operating a vehicle. That's a 3000 lb. weapon traveling upwards of 50 mph (in most cases).

Comment: Osun> I hear you however in some cases, your insurance company makes you sue. The family I mentioned...the insurance company wanted the owner of the vehicle to press charges against his son. In the case of that family the insurance company doesn't have to fix their car because their son was not an insured driver and he did not have permission to use the vehicle. The insurance company can also cancel the policy because it was a breach of contract. It's not always about profit from death -- insurance companies don't make money when they pay out.

Comment: If Brandy was on a cell phone, her phone records should clearly indicate this (assuming they can pin the precise time of the accident to the minute). At any rate, most people believe that if you hit someone from behind, the accident was all or mostly all your fault.

Comment: Osun> would your view change if you were the car that Brandy hit....and it was your car that hit the car in front of you which forced that car into the opposite lane and crash & kill the people inside? You'd sue Brandy too because if Bandy did not hit your car -- you would not have hit the car in front of you causing that women to lose her life. Sometimes lawsuits are about accountability and establishing who is at fault.

Comment: Teigh is right...since most people don't read auto insurance contracts (or any other contracts, for that matter) before they sign them, most people don't realize that there is a provision in the contract which states that should you be involved in an accident for which you are not at fault, you agree to sue the person at fault and the insurance company will pay all costs associated with the litigation. This provision is there for just the "business" reason Teigh said...insurance companies don't make money when they have to pay claims.

Comment: Thank you BigDog, I recall hearing that a while ago too. I wasn't sure if it was a rumor or what. Talking on a handheld is risky enough, but I hope to God she wasn't text messaging while driving. It's illegal to use a hand held in NY, yet I see people do it all the time.

Comment: Osun - Just like Brandy's accident caused a chain reaction that ended with the death of a woman, there's a connected chain of all of the people involved in that accident. If someone hit your car causing you to drive into and KILL somebody, don't you think that would leave you jacked up?!? It's easy to say that folks are just suing for money, but if you now suffer from PTSD because of someone else's recklessness can you blame someone from wanting you to take responsibility for your injury, too? This woman has to live with the fact that her car killed somebody regardless of the fact that it was not her fault. And don't think it's just rich folks who get sued in accidents. I was sued by another driver in a minor fender bender. And although I felt that driver was full of it, I learned a great lesson about paying attention on the road. Luckily I just hit a bumper because I was distracted, it could easily have been a kid I hit.....

Comment: Teigh, I am not a person who tries to get over and get money at every opportunity so unless I had bodily harm done to me, or the insurance company forced me to sue, I would just rumble with the insurance company. I try to do what is right or at least what I think is right.

Comment: BigDog> thanks for that info...If Brandy's handlers were really looking out for her best interest (especially in light of her concern for these excessive lawsuits that are standard procedure) she would settle with as many of them as she resonably could. She incriminated herself immediately after the accident and they will use those statements against her. She can pay the lawyers...or she can pay those whose lives were effected, or she can pay both!!! OSUN> I hear you and I hope you have adequate coverage on your vehicles and your personal property because the world and insurance companies don't operate with the same conviction that you do.

Comment: OSUN - There is nothing wrong with your convictions or your position. And I'm not saying someone should sue to "get over" either. I agree that there needs to be an injury. However, emotional distress is an injury as well. My uncle saw his best friend's head get blown off and it f*cked him up!! He was a mess for about 3 years and still suffers from PTSD. He needed some serious therapy and he still suffers from insomnia and panic attacks, which made it impossible for him to work until his doctors were able to get him on the right mix of medications. Not everyone has the same resolve to deal with tragedy. If this woman is truly suffering from emotional issues directly related to this accident, those issues are valid, too. And no, I'm not saying she deserves millions, that's ridiculous, but if she ends up not being able to work for a few months due to her mental state, I don't think she should have to suffer a financial loss because of it. And as Teigh said, she may not have had a choice but to sue Brandy. Insurance companies can be FLAKY, just ask folks in New Orleans. My only point is that we shouldn't just jump to the conclusion that this woman is looking to "get over" just because she's suing and saying that the children and her husband are the only parties worthy of compensation seems a little harsh for those who may not have broken ribs, but suffer just as much mentally. JMHO

Comment: All these folks are looking for a quick come-up. I realize that Brandy shares some of the fault, but if she weren't a celebrity with money all these lawsuits wouldn't even be filed. I'm glad she isn't going to roll over and give out the money.

Comment: After being slammed into a median wall, I understood why people sue. I suffered neck and back injuries and the fear of driving for about a year, so I felt I should be compensated financially for these life changes. However, I settled with their insurance company, rather than sue the car's owner for millions (as if he had that kind of money). I believe these people are doing this because the driver is a celebrity. I doubt they would make these big lawsuits against an average person. They should get reasonable compensation, not a payday.
