Comment: What is this 4 or 5 columns in a row from Roger Friedman regarding MJ? LOL! Now didn't that fool just say, that NOBODY is interested in MJ? LOL! The list of Friedman contradiction's continues to grow. If what Roger is saying is true, it looks like BET was VERY interested in MJ. They not only wanted him to present an award to Ms. Ross, they ALSO wanted to do some type of Thriller anniversary segment. Friedman also had MJ "bedridden" in the past few days. Well it must have been a MIRACLE recovery, now that it has been reported that MJ is in Maryland looking at vacation homes.

Comment: Here's some REAL news regarding MJ. The TimesOnline has an article entitled "SONY BMG SEEKS MICHAEL JACKSON'S BACKING FOR MOVE TO SIGN SONGWRITERS". It goes on to say that Sony is in talks with MJ to renegotiate the terms of their music publishing joint-venture, which would allow SonyBMG, the sister company, to sign songwriters for the first time. There is an apparent clause in Sony/ATV's agreement that prevents SonyBMG from doing any publishing type business. What I find interesting is that SonyBMG needs MJ's approval to move ahead with their songwriting plan. The talks are in the early stages. It will be interesting to see how this plays out and IF MJ gives them his approval, will they have to PAY him for same. Very interesting indeed!

MEXICO CITY — Mexican tycoon Carlos Slim is the world's richest man, worth an estimated $67.8 billion, after overtaking Microsoft Corp. founder Bill Gates, according to a respected tracker of Mexican financial wealth on Monday.
A 27 percent surge in the share price of America Movil, Latin America's largest cell phone operator controlled by Slim, from March to June made him close to $8.6 billion wealthier than Gates, said Eduardo Garcia in Sentido Comun, the online financial publication he founded.
Garcia estimated that Gates was worth $59.2 billion.

Comment: As to the Thriller 25th anniversary celebration. I read on this very board that they are planning a 75th birthday celebration for Quincy Jones next year, which will include the recognition of his work. Since Thriller is the biggest selling album of all times, I'm sure it too will be recognized during this birthday celebration. On top of that, Simon Cowell from American Idol, said a month or so ago on EXTRA, that he is working with Sony to do some type of Thriller celebration. He didn't want to elaborate, he said it was all hush- hush at this point, but that it would be HUGE! So I would "think", the celebration of Thriller will be taken care of, in one way or another. LOL!

Here's the whole article -
From The Times -

Sony BMG seeks Michael Jackson's backing for move to sign songwriters
Sony is in talks with Michael Jackson to renegotiate the terms of their music publishing joint-venture, which would allow Sony BMG, the sister company, to sign songwriters for the first time.
A clause in the existing agreement between the Thriller singer and the Japanese electronics giant prevents Sony backing a music publisher to rival their Sony/ATV venture, which has the copyrights to all 252 Beatles songs in its catalogue.
If Sony can persuade its volatile and cash-strapped business partner to relax or even erase the clause as part of the negotiations, that would allow Sony BMG, the recorded music concern, to become a part-competitor.
Sony BMG is desperate to enter the music publishing market because it would help to offset the collapse in recorded music and would allow the record label behind Justin Timberlake and Bob Dylan to sign up songwriters in tandem with acts.
Recorded music sales are expected to be off by as much as 11 per cent this year, but publishing has been more stable because it generates income from growing areas, such as radio airplay and use of music in advertising as well as CD and download sales...

Rolf Schmidt-Holz, Sony BMG’s chief executive, said in May that “we will do everything to reenter the market for music publishing”. His remarks surprised rival executives, who knew that a decision to go into publishing was not within his power. However, the existence of the previously unknown discussions explains his confidence.
Discussions between Sony and Jackson are at an early stage and could collapse. Relations between the two have been strained in the past. Sony/ATV has faced problems making acquisitions because contacting the controversial star quickly enough to agree bids has been difficult.
Jackson recently agreed to allow Sony/ATV to expand aggressively under Marty Bandier, the newly appointed chief executive. The company now also has an option, which it has so far declined to exercise, to buy a further 25 per cent of the business from its partner.
It is unclear how far the shareholder agreement between the two parties will be relaxed. There are hopes that Jackson will not have to be paid, although if that is the case he is likely to insist that Sony BMG can only sign up a handful of songwriters.
Half-owned by Sony and Bertlesmann, of Germany, Sony BMG is the second-largest recorded music company in the world, but it is unique because the company does not include a publishing arm.
The music business is traditionally split into two halves. Recorded music operations find, develop and promote artists, while music publishing units handle and manage songwriter copyrights. Its rivals Universal, EMI and Warner Music all conduct both activities.
Sony and Sony BMG declined to comment.

Comment: POWERFUL POSITION? not really. The position that Michael is currently in is losing money for both SonyATV and himself. Marty Bandier ("Mr. Music Publishing" if anyone really knows the business) is now heading the SONYATV publishing arm. Marty was the marstermind behind EMI purchasing the Jobette (Motown) catalog (EMI first owned half and Marty negotiated that if Berry Gordy ever sold the other half EMI would have first rights) You can only make so much money off a catalog (old songs), and while the ATV catalog has jewels (the 252 Beatle songs) -- I would bet that those 252 songs are pulling in most of the money for licensing for that whole ATV catalog. This re-negotiating is all about relationships and taking ATV forward. Sony can't sign new writers; MJ is only really making major money (25%) off 252 songs, and Marty Bandier is positioning Sony to compete with EMI & Warner in the publishing game.

Comment: Teigh, what are you talking about? POWERFUL POSITION - YES! The article clearly states that SonyBMG CANNOT move forward with their plans, unless MJ gives them his approval to relax the clause which appears in the Sony/ATV agreement. How can you say that the approval of ONE man, is not a powerful statement. (They are going to have to dangle a big ole GOLDEN carrot in front of MJ, if they want to gain his approval. LOL!) Also, Sony/ATV now contains OVER 500,000 songs. The Beatles 250 songs are just a DROP in that very HUGE bucket which is the Sony/ATV catalog.

When I licensed Beatles songs (and It's been quite a few years since I have the going rate for :30 seconds was 1 million dollars! How much are the Beatles songs getting now? How many studfios and advertisers have that much money for a song in a market where sales are down? and are the other songs in that catalog making that much money per use? My gut says NO! If he doesn't relax the clause, SONY and MJ lose!

Comment: MJ is STILL in possession of his entire 50% of Sony/ATV. And he is not only earning money from the 250 Beatles songs. He earns money from the ENTIRE 500,000+ collection of songs. If he only had a 25% share, I don't think SonyBMG would be asking for his approval for anything. If MJ only had a 25%, that would make Sony the majority shareholder with 75% and if they had a 75% share, why would they need MJ's approval for anything.
|

Name:

Comment: I disagree, if he relaxes the clause, Sony/ATV and SonyBMG become competitors. Sony will come out on top, because they will earn money from the benefit of owning two different publishing houses. Bottomline, if they want to gain MJ's approval, SonyBMG is going to have to sweeten the pot.
|

Comment: Michael get's approximately 25% of each licensed use. Paul McCartney and Yoko Ono each get 25% for each licensed use as writers of the songs, and Sony get's the remaining 25%. Are the rest of the songs earning the same amount of money per use as those 252 songs. You're also not considering that while they need MJ's approval, MJ also owes SONY BMG a whole lot of money for the last two album flops. MJ has the clause, MJ has a huge debt with Sony, Sony wants to expand their publishing companies to compete with the digital age. It's an opportunity for both to get some relief. Trust me, the deal will happen. So what about the rest of the songs? I believe you said there were like 500,000 -- what kind of money are they bringing in per song?
|
|
|
Name:

Comment: Showtime, Owning a catalog does not mean you get all of the earned money from the songs in the catalog. The writers of the songs still get paid. Your earlier posts give the impression that you may not be aware of that. Berry Gordy once owned Motown, Trust me Stevie Wonder got (and still get's) the larger percentage of income per use for his Black Bull Music songs that are incorporated into the Larger Jobette catalog!

Comment: I have no idea how much money the remainder of those 500,000+ songs earn on a daily basis. But since the songs are used WORLDWIDE, in commercials, televisions productions, stage productions, movies and radio, I would have to say that the songs earn quite a bit of money. WORLDWIDE use ain't no joke, it's a big azz world! I don't believe MJ owes Sony/BMG any money. Where did that information come from? If that were true, I think it would have been mentioned in the article that MsMo posted today. I mean, since the article is talking about SonyBMG, I'm sure the author would have found a way to incorporate that information into this article, IF it were true.

Comment: Showtime,
you forgot to mention EVERY time ANYBODY sings those songs commercially WORLDWIDE LOL! But you're right, they need his approval and he had to agree for Bandier to be hired.
Hmmm, why haven't they exercised that option to purchase 25% of his 50 or more?
My understanding is that option is only valid IF he defaults on the loan taken out against it. All things considered, my guess is that IF he couldn't make a payment any reason, his millionaire sister or any number of his billionaire friends would be happy to make it for him.

Showtime, Teigh and MsMo, you all make some very good points so it will be very interesting to see what Marty does to smooth out this matter. If Michael is smart, he'll bring The Godfather, Clarance Avant on board as one of his top advisors. Clarance knows how to deal with the corporate brass, he's a genius/legend in the music biz world and the whites folks at the top have major love for him.

Comment: Streetdancer, i agree with you...but my comments were specific, showtime spoke to generalizations. I am convinced that those 252 songs bring in the larger share of publishing income for Sony, and how many times has MJ been bailed out for almost defaulting on those loans? MANY!!! Clarence Avant would be a great choice to advice him. Owning something does not necessarily mean that one knows what to do with it beyond leveraging it.

He has certainly had his ups and downs, but through it all, he has managed to hold on to his 50% interest. And if SonyBMG wants to compete in the world of publishing, they are gonna have to do a bit of "back scratching" with MJ. He's gonna use what he got, to get what he wants! LOL!

Comment: showtime, anybody with knowledge of that ATV deal knows that SONY ATV is a joint venture (key word JOINT VENTURE) with MJ and now SONYBMG. |
|
|
Name:

Comment: They are not one & the same...because if they were this story would be a non-event. The concern is that if SonyBMG signed songwriters there is the potential that Marty Bandier can increase the value of SONY BMG while limiting the income potential of the ATV catalog. If the ATV catalog (minus Northern Songs) were bringing in the worldwide cash you speak of, they would not need to do this.
|

Comment: First of all, Marty has NOTHING to do with Sony/BMG. Where did you get that from? Marty Bandier is the head of Sony/ATV. If Sony/BMG is able to start a publishing arm, Marty won't be involved with that, unless he leaves Sony/ATV.

Comment: Tiegh, you need to read that article again. Sony/ATV (MJ) is not in a joint venture with Sony/BMG. Nor are they trying to be in a joint venture with Sony/BMG. Sony/BMG would like to set up their OWN publishing house. They only need approval from MJ to do so.

I think that Sony/BMG is the one who NEEDS the deal. It could be lucrative for Sony/ATV(MJ), but they don't NEED it. The Sony half of Sony/MJ is just lookin' out for the Sony family of companies.

The music business is in the dumps and as the article clearly states: "Sony/BMG is DESPERATE to enter the music publishing market because it would help to offset the collapse in recorded music..." Sony Entertainment Inc. owns
1) Sony Pictures Entertainment Inc.
2) 50% of Sony BMG Music Entertainment

Comment: Ms. Mo, you're correct but as you noted the Sony BMG interests are halfed because SONY BMG is a merger with Sony & Bertlesman. In addition to their music divisions, they have Entertainment, Video Games, Computers, televisions, etc. Sony ATV is a joint venture that is a part of Sony's music division. And you're right MJ does not the deal they are proposing, BUT ATV (minus the Beatles songs) are not bringing in cash -- why else would they need to do this? Showtime has yet to refute that point with specifics for songs (other than Northern Songs) that are making real money for Sony -- worldwide!
