There are some other variables here. First, it would be a defamation of character suit. Slander is "spoken" libel is "written"...this videotape is neither.
Also, there's a proprietary issue at play here. The argument is whether a person has the "right" to surreptitiously photograph/video a celebrity and also disseminate it via email/phone lines. There likely is a wire issue.
Putting his name out in the public too soon without having all his ducks in a row might be a bit unwise.
Obviously I'm not a lawyer, but given the magnitude of this story what it's become. It's prudent for him to wait.
But do note that if this video were absolutely fake and untrue...Vivica likely would have come back far, far stronger in her denial. That hasn't been the case thus far. Sounds a lot like the baseball players denying they've been using steroids.
Oh...okay...if you say so. Then here comes the Mitchell Report (i.e. videotape) and people start changing their stories. There hasn't been a categoric denial thus far. It's been a carefully crafted non-specific denial. There is no in-between here.

But the denial itself (if factual and actual) doesn't need a lot dressing up. One can emphatically deny a lie if it is in fact a lie. I'm not sure about "due diligence" in emphatically denying a falsehood.

And I don't know that MTO "put out" the tape. Yes, it first appeared on their site and nobody would take MTO for CNN...but I'm not so sure we can make the leap that they were the originator of the clip/tape.

Unless someone else was in the room and that was never stated. It's shot from the side with an actual video camera!! But no one is even addressing that fact! Something is said and that's good enough for sensationalism so it qualifies as a good story??? What kind of %*$! is that?
