Comment: It's really a shame that this is not the law, however this is also COMMON SENSE. The whole thing is an unfortuante tragedy and while the Doctor was cleared....he is still sleezy in my book because he had some knowledge that her existing conditions could pose a problem (even if she did not tell him what the previous doctor told her). Instead he took the money!

Comment: Well said Teigh. I'm surprised that with all of the types of surgeries of this ilk that there wasn't a law in place already. Especially in Tinsel Town where elective plastic surgery is virtually the norm there. Kudo's for getting this started though. I would be pretty shocked if this bill didn't get passed.

Comment: This is great. This should be required in every state. A doctor can only go by what a patient tells them, so if a plastic surgeon requires a patient to have a physical exam, then he/she will be more informed.

This was an educated woman who was told that she shouldn't do this surgery and yet she kept persuing it. This law will change nothing.

Comment: Yeah well common sense would tell you not to drink and drive but people do it anyway and because of the laws of this land, they are penalized for it. In this case, if the law spreads like it should most doctors who don't have common sense and decency to require clearance ahead of time would come to understand that if they greenlight surgery without it, they will be subjected to the highest order of the law and possibly lose their medical licenses, they have a lot more to lose than the average joe law breaker and a much higher standard to uphold.

Comment: There are Laws in Finance that protect credit companies from taking advantage of people. The FCC passed laws so telephone companies can't take advantage of you, why not surgeons.

Comment: I understand both sides, those who believe this law will be good and those who feel that people should be responsible and accountable for making their own decisions. Thankfully, we have some laws in this country to protect people from themselves when they don't think or act in their own best interest. The current mortgage crisis is an example of people not educating themselves and making good decisions, as well as some business people preying on them. Payday and title loans are another. I believe both parties (ignorant consumer and predatory vendor) should accept responsibility when necessary.

1) the limits (futility?) of the law
2) the fallibility of human nature (people will find ways to circumvent the law)
3) the power of capitalism to undermine legislation

Comment: I think it will be a good law. But lots of people are addicted to plastic surgery or get really swept up in thinking they "need" it. I can see those people circumventing the law by just hopping a plane to Brazil or Argentina. So while it's a good law, I don't think it will stop people hell-bent on avoiding the gym at all costs or not wanting to live with their own nose for one more minute.

Comment: People wanting to change their physcial festures to make themselves more beautiful or acceptable is a spiritual issue and until they chnage their self=views based on DIVINE TRUTH, they will still have the desire to circumvent man made law and spiritual law...
one of the ways they do it is to do what so many did: blame the plastic surgeon for Dr West's choice

Comment: This is a bad law. All medical procedures have some type of risk. Getting a Dr's clearance does not remove the fact that complications happen. Furthermore, a patient can go to two different doctors and get two different diagnosis. And the funny thing is that both doctors could be right.

Comment: Good points Calidee. There is no comparison to drunk driving laws which are design to protect the public, not the person behind the while. A better comparison would be seat belt laws, which I also think are stupid. The comparisons to the FCC and laws that regulate financial institutions are also somewhat weak because plastic surgery is very proactive. Unless I've missed something, plastic surgeons aren't bombarding us with ads in the mail or on TV. I don't recall seeing any infomerials. Even with the credit card industries, there should be regulations to protect people who are in crisis such as when people have high medical bills, but I don't feel sorry for people who live beyond their means. I knew someone who had 9 credit cards and then was mad at the companies for wanting their money, but this person wasn't using those cards to buy food or pay rent, it was all about getting stuff, more stuff, and then even more stuff. Instead passing even more laws to further put burden on an already over burden legal system, why not spend that time and money on education. Finance and logic should be requirements in school, but I don't what you do about common sense.

Comment: Excellent point Khufu, humans need parameters because we all have to live here with each other, but there are those who are too foolish to look out for themselves and by the way DOne-drunk drivers can and do hurt themselves too. This is the problem with Capitalism, doctors should not be so greedy as to be above looking out for those who can't or won't do it for themselves. If medical personnel aren't held at a standard to look out for the rest of us, then why should we trust them at all? Not to mention their own medical liability. That line has to be maintained and in the case of Dr. West's surgeon, as in so many others, it was crossed, so he pays the price and she paid with her life.
Its the same problem with the rest of the industries in our countries. Music makers say its up to the parents to keep their kids from hearing certain music, but they bear some responsibility as well. We are supposed to be each other's keepers and not so biased against what we think is right or wrong that we sit back and judge each other instead of helping each other.
