They've proven that the tape is real but they have to prove that it was an underage girl in the tape. The young lady in the tape is now saying that it was not her (because she's probably been paid off). They had another witness, one of the young girl's friends, who was to testify that the girl in the tape was indeed her friend and verify her age at the time but that's not enough for a conviction. There was also talk about the prosecution bringing into evidence documents showing that he married Aaliyah (God bless her soul)when she was 15yrs old. Her parents had that marraige annulled.

Comment: dcdouglas, statute of limitations is the period of time that the state has to 'charge' the individual with a crime. It has nothing to do with when the case actually 'goes to trial.' In R. Kelly's case they charged him a number of years ago, so there is no statute of limitations problem/issue, because he was charged more or less close to the discovery of his crime.
