Comment: It's that same arrogance that got him fired in the first place. I'm convinced that Isaiah is indeed a knucklehead. TV ratings are down PERIOD! Most tv show ratings are lower than pre strike levels. Grey's Anatomy ratings are really down. The spotlight on Izzy isn't working...perhaps Shonda by including this photograph and Dr. Burke into the story line was getting back to basics and at the same time putting feelers out for his possible return next season. But nnnnnnoooooooooooo Isaiah has to act like the fool he is..and further alienate himself from ABC (I don;t see that Bionic Woman show on the listings...it got cancelled!) NBC hasn't announced plans for him during their upfront presentaiton in the last few weeks so it's not like Isaiah has a whole lot of work lined up....just a fool a dang fool!!!

Prince sends cease and desist letters to every website and he can't. I'm not a fan of Isaiah, but right is right. Maybe this is all some ploy to bring him back, but he should get paid. He got FIRED, and they got nerve to use his imgage. They could have put any generic black man there, and it wouldn't have made a difference. Exposure is what actors want and should concentrate on especially when they have offended so very many people that literally could obliterate him before breakfast. Comment: The image used was not the image of Isaiah it was the image of the character he played on the show. Does he own the rights to the character or does the show own the rights to the character he played on the show? I work for a major insurance company and I know the company still runs national ads and has poster throughout the company with images of people who are no longer with the company. Some left by their own will and some were terminated.

The show's ratings is tanking and I guess they wanted to ignite some controversy to get folks watching again. If he didn't feel he was within his right(s), he would not have filed the complaint. That's like saying that because a corporation hires you, that you are still 'obligated' to them after they fire you.

Comment: Teigh, I almost went into convulsions when you mentioned that mess of a tv show the Bionic Woman. That show was utter trash and I stuck with it week after week hoping it would get better. Getting cancelled was long overdue. And Isaiah's short run on it was "okay", but nothing to write home about. Journeyman though, deserved second life.

It's just like record company executives being able to make money off the songs the artists make till the cows come home and the artist may get residuals (a pittance compared to). If the artist owns the masters the world is their oyster.

Comment: I don't think Isaiah is an idiot at all. They may have creative license over the character, but they can't just up and use an actor's image without his consent. It's like a music producer sampling another artist's music or voice without consent and without paying him. If you were in the business or aspired to be in the business you would understand better. I didn't watch the show, but I didn't see the significance of using his image and former character in the storyline except to grasp May sweeps ratings.

Comment: Southernbelle, We are not talking about high school here, and even then parents are given the option to say yes or no as to whether they want their child's image used or not. But here we are talking about the workig world of Hollywood, and an entertainer's image is his property. Unless it's written in the contract that the show producers have the right to use the actor's image in future shows after the actor has left the show, these people must pay him. Incidently, the show was created and is exec produced by a Black woman. Anyway, Isaiah's career is far from lackluster. He's been in a variety of movies and t.v. shows, and has one coming up with Oscar winner Forest Whitaker.

Comment: I'm with Isaiah on this one. This is a rights issue. You have to have consent to use someone's image/likeness period.
He is taking the correct course of action, having nothing to do with the silliness that led to his termination. This shouldn't be viewed as an "Isaiah Washington" thing, it's a "Hollywood" thing. This type of lawsuit would likely happen no matter who the infringed party is.
Let's remove Washington's past from this discussion, it's irrelevant. He has legal grounds for this, his image/likeness is an actor's bread and butter.
Isaiah may not be the best "person" around, but that's neither here nor there in this regard.

Comment: Isaiah needs to go somewhere, sit down, meditate, and work on his life, career, and future - they already kicked him to the curb, and he is only making things worst for himself - he is now labeled a trouble maker in the business and no one will want to have him on their project because they don't know what kind of a bag he gonna come out of from one minute to the next. Programs have always used the image of performers, past and present, fired or otherwise; I see IW point, but, he gave the shows permission to use his image when they hired him.

Comment: I've yet to see ne1 commenting on GA's "right to use his image" actually state where that is a fact. IW didn't just become an actor on Grey's, he's been one. It's logical to assume that he and his attorney knows what "is" and what "isn't" allowed. SAG is the actor's union for a reason. If they agree w/and back him, he will be vindicated. It's wild that absent ANY facts to this story, people are telling him to sit down, he's arrogant, and that he has no right to his image. Teigh, ur usually the entertainment expert, so tell us what the rules are re: an artists rights to his image.

Comment: Like him or not, Isiah is right on this one. I work in marketing and advertising and image rights usage is a big azz deal. No advertising campaigns can be run until all clearances have been received -- music, photography, quotes, etc. No one has the right to use a company and/or person's image, music, logo, etc. without express written consent. If IW didn't give it, ABC needs to just settle and pay the man.

Comment: okay kwrob, I'm just saying. I would assume tv execs. make the point of image usage early on. Personally, I don't know the specifics. I only gave the example of high school policies b/c even they are savvy enough to know that there could be a potential lawsuit from any financial gains made due to students' image use. So they make the point up front. Once they photograph you they own the photo. Forgive me for believing that multi million dollar tv execs are just as savvy. I still believe Isaiah got screwed big time over his firing and I hope he wins his case.

Comment: vincent2for2...if your company is still using images of former employees in its advertising, these folks probably signed photo release agreements giving your company the right to use their image/likeness/photograph/etc. in its marketing/advertising. It doesn't matter whether or not that they are no longer employed by the company. The only way they'd have legal recourse is if the exclusive rights your company has on their images expires after a certain time period.

Comment: Piggybackin' off of CrazzeeGyrl: the ONLY reason Isaiah may have a case is because they used a PHOTOGRAPH/IMAGE of him to portray the character. Yes, the CHARACTER belongs to the show, not the image. That's why it wasn't a problem to SAY or WRITE or REFER TO "Dr. Preston Burke" but once you associate the IMAGE to that CHARACTER it seems there's the distinction. Think about it: if another photo had been used other than Isaiah, it would not have been believable or credible. But if Shonda had done a pre-emptive strike by requesting usage of the image beforehand, Isaiah could have probably caused some trouble. It's better to ask (and pay) for forgiveness than permission. Hmmmm....

The "image" in question is a headshot, not a still from a previous Grey's Anatomy show.
Meaning...
The rights for that headshot were already in place before use in any other media. ABC/Grey's Anatomy clearly has the rights use/re-use any already filmed footage containing Washington,
But re-purposing a copyrighted image for some other use...that's a no-no and you don't have to be a lawyer for that.
Take the personal feelings toward Isaiah out of the equation and look it at it objectively and through the lens of legality/illegality.
Isaiah is right if everything stated in this report is true.

I'm a cynic, and frankly I think they already had the check written when the did it. They need something to put a fire into the show. It's losing viewers after rerunning every episode 10 times a week during the strike. I wouldn't be surprised if Shonda did the whole thing herself, and dared him to sue so they could get the publicity.
