Comment: It's not that simple. They will ask him where he would like to stay and why. But it is based on alot more than that. They look for stability, school, living accomodations, etc. The boy can say he wants to stay with his mom because his dad is too strict, which is not a good reason to let him stay with his mom. Also you have to keep in mind, Dame has sole custody of him until he is 18. They have to look out for the best interest of the child, which at 16, he is still considered a child. If you had a 16 year old and had full custody, would it be that easy for you to let that child go, simply because he wanted to leave?

Comment: an arrest for a 16-year-old??? come on! at 16 he should be able to testify in court as to which parent he prefers to be with. unless the mother is proven unfit, i don't see any reason to waste the court's time with this.
