Comment: Somebody thinks the case has merit, otherwise it would have never come to trial, but does she know for a fact that Tyler saw the play? And if she wrote the play in 1991 and she thought it was so great, why didn't she take steps to take the play nationwide or something? Point is if Tyler could write and find someone to make his movie, if that's what she wanted, could she not have gone the Tyler route herself, as well? Or is it a case that she didn't think much of it till she saw "Diary" then decided that she was robbed?

Comment: From reading the EUR article, you could conclude that this isn't looking good for Mr. Perry. But, I decided to go the Marshal News Messenger website (http://www.marshallnewsmessenger.com/news/content/new s/stories/2008/08/120308_web_perry1.html), I found more info that paints a different light, like this: "Ms. West "lived in the Dallas/Fort Worth area" and she contracted with Curtis King — founder in 1977 of the Black Academy..."King is a writer," who is sponsored by Arthur Primas, Pittman said, and Primas "brought Perry to Dallas in 1998 when (the actor) was struggling and broke. "Perry spent 40 hours a week at the academy," "There was a partnership between Perry and Primas," Pittman continued. "He had to loan money to Mr. Perry" before the making of the film. Pittman claimed Perry paid Primas $5.4 million of the proceeds from the film "and he (Primas) got more off the play" Perry wrote by the same name." So it looks to me like Perry tried to cover his bases with this Primas guy. Maybe he thought Primas owned the rights to the play? That's what's not clear, did Perry know this lady wrote the play or not? If he did, he's probably liable (but not definitely so since she didn't get her ish copyrighted). But if he didn't, seems like this lady needs to be suing this Curtis King guy or Primas instead of Perry. Just my pseudo-legal posturing, lol. I'm interested to see how this one unfolds.

Comment: TGen, Thanks. I did wonder if she got the play copyrighted. Seems like Curtis King can supply some of the missing links because he was the common denominator here. If he got a lil change, and if he knew that this was Ms. West's idea, that ain't right. So, basically, Ms. West got screwed in her relationship with Mr. King when Mr. Perry was brought to Texas. What does Tyler say about where the concept came from?

Comment: Doesn't look good for Mr. Perry, though because the article I just read says that Ms. West did have her work copyrighted. And I see that Mr. Perry drew on his life experiences for "Diary", allegedly! I wish him the best -- And Ms. West if her claim is legit.

Comment: I agree with previous posts that something just doesnt seem right. First of all, Tylers movies, including Diary, supposedly came from his plays. All of his plays were done before the movies. Second, most movies have similar themes and concepts but carried out in different ways. How can you take ownership of a concept or theme. Third, if you have a copyright for your material then I would think that's your legitimate right to sue if your work was stolen. Finally, there are a lot of movies about a woman being divorced, abused and what not by her husband, significant other, etc. Heck there are books that have the same concept. I believe if Tyler was wrong in any aspect of this he would've settled and waived his right to a trial. He probably went to trial to clear his name.

Comment: With money comes problems,somebody is alway's trying to sue claiming their idea was stolen. If the play was copyrighted before Tyler Perry's play and movie then her claim may be legitmate. I think this curtis king guy is the culprit.

Comment: Ms. West's original work did not have to be officially copyrighted. She could've written it, and he could've stolen it. What needs to be proven is that she DID in fact write it (or the material in question) FIRST. A theme is an underlying MESSAGE. The theme of "Diary" is not "a woman being divorced, abused and what not by her husband." I LOVE Tyler Perry, but his lawyer is full of "shyt" about the "original copy" and how he sends all his work to the Library of Congress. He's trying to be a smart-as.s with that. What happened to any extra copies the writer may have made because of the fear of losing the original? I REALLY HOPE it's not true, but if it IS, Tyler's big azz had better pay UP!

Comment: Yeah, I didn't like that bullshit excuse his lawyers used either about mailing the original to the Library of Congress for copyrighting. I wonder if the LOC could provide details as to when they received the scrip for copyrighting, etc.....

Comment: whenever you write a script, you send the ORIGINAL TO THE LIBRARY OF CONGRESS and KEEP THE COPY OF THE SCRIPT, A COPY OF THE COPYWRIGHT FORM AND

Comment: SHOOT, MAKE A COPY OF THE RECIPT OF THE CHECK OR MONEY ORDER FOR THE COPYWRIGHT. always to cover your stuff to keep mess like this from happening. so if anybody want to try claim that you stole your stuff you have legitamite back up to defend your own work. whenever i send stuff off to be copywritten, i always make a copy of the form, and when the LOC sends you the copywright certificate, make a copy of that and file the certificate so you can get it whenever you need it.

Comment: The copyright certificate is unimportant. Whenever you put your work down on a sheet of paper or any type of "durable medium," a copyright is created.

Comment: Did she copywrite it PERIOD. And if so when? If she had it copywritten the day before the trial who would believe that? AND if she performed the play for those days way back in 1991 DID ANYONE VIDEOTAPE IT? A video from 1991 would put all claims to rest. If she had it copywritten AFTER the movie came out well damn then she just had a drunken stupor, rewrote the movie with her name on it and decided to cash a check.
