Toddler Finds Gun in Car, Accidentally Shoots & Kills Mother While Driving

*A 26-year-old mother driving her two young children on a Milwaukee freeway is dead after her 2-year-old son found his father’s weapon on the floor in the back seat of the car.

On Tuesday, Patrice Price was driving with her one-year-old in the front passenger seat, while her two-year-old sat in the back. According to a report in the New York Daily News, neither child was wearing the required seat belt, and the child seated in the back apparently picked the gun up from the floor and fired it into the drivers seat.

The bullet traveled through the seat and hit Price in the back; sending her car into the rear of another vehicle before it came to a stop on Highway 175.

Price was pronounced dead at the scene. No word on the condition of the other driver.

Andre Price said his daughter, Patrice, was a hard-working mother who had three children.

“This little girl right here meant everything in the world to me,” Andre Price said. “And I lost the other half of my heart.”

Additionally, according to WISN 12 News, Patrice Price did not have a license at the time of the shooting and was wanted on a Waukesha County warrant for driving without a license.

Her three children are staying with family.

It’s not clear if Price’s boyfriend could be charged. He has not been arrested.

WISN 12 News looked into whether Wisconsin law, homicide by negligent handling of a dangerous weapon, would apply in this case.

The statute reads, “Whoever causes the death of another human being by the negligent operation or handling of a dangerous weapon is guilty of a Class G felony.”

WISN 12 News reporter Mike Anderson asked defense attorney Craig Mastantuono if the boyfriend, and owner of the gun, could face those charges or something similar.

“That may be difficult to charge, quite difficult, and I think it would be a stretch to charge the firearm owner with risk, harm, or death to the child’s mother,” Mastantuono said.
