Judge Shuts Down Kevin Hart’s Attempt to Have $2M Lawsuit Dismissed

*A  New York judge has shut down Kevin Hart’s attempt to get his former partner, iGo Marketing & Entertainment’s $2M lawsuit against him thrown out.

According to court documents obtained by The Blast, the order notes that Hart’s former partner has provided enough evidence for their case to move forward.

The judge denied Hart’s motion to dismiss stating, “The Court concludes that the defendants have failed to establish entitlement to judgment as a matter of law and that there are material and triable issues of fact presented and thus the motion for summary judgment must be denied.”

The case is tentatively scheduled to go to trial on January 17, 2019 — right around the time the actor will be rehearsing for his Oscar-hosting duties on February 24.

As The Blast first reported, iGo Marketing & Entertainment claims the “Night School” star failed to follow up on his end of a deal that involved “marketing and celebrity tie-in deals” on Hart’s behalf. The company claim Kevin agreed to give them 15% on any deal they negotiated.

In the lawsuit, iGo alleges they secured numerous deals for Hart over the years, such as partnerships with Miller-Coors, Coke-Zero, Vitamin Water, Electronic Arts, two deals with Caesars Entertainment, the Cosmopolitan Hotel and Verizon Wireless.

In 2015, iGo claims they negotiated a three-year deal between Hart and Rally Healthcare that called for him to get paid partly in cash and part in stock options. But that same year, Hart terminated the deal with iGo and did not pay them their 15% on the third year option of the deal or for the value of the stock option.

They are suing for breach of contract and are seeking $1.8 million.

Hart responded to the lawsuit, claiming he never had a written agreement with iGo, and that the Rally deal didn’t kick in until after they parted ways, so he doesn’t owe them 15% of that money.

He counter-sued iGo for allegedly using his name and likeness for marketing on their website without his permission.

Kevin Hart is demanding the lawsuit be dismissed and that the court award him unspecified damages for the use of his image.
